- Horse and Talent

1. Scope of Services

Horse and Talent provides independent senior advisory, analytical, and educational services within the international equestrian sector. Services may include, but are not limited to:

strategic and analytical advisory on performance, talent development, and welfare;

advisory support to riders, owners, trainers, coaches, and other relevant stakeholders;

reflection on educational structures, organisations, management, and policy-related matters;

educational contributions such as advisory sessions, meetings, workshops, clinics,

or authored written works, including published books.

All services are of an advisory and analytical nature. Horse and Talent does not provide training, management, or operational services and does not make decisions on behalf of the client. Implementation and decision-making remain entirely with the client.

 

2. Nature of the Engagement

Services are strictly advisory, Horse and Talent:

provides professional guidance and analysis;

does not perform management, operational tasks, or training;

does not guarantee specific sporting, commercial, or organisational results.

All decisions, implementation, and execution remain the responsibility of the client.

 

3. Information and Assumptions

Advice is based on information provided by the client, professional observations, expertise, and relevant scientific insights. Horse and Talent is not liable for inaccuracies, omissions, or decisions made by the client or third parties based on the advice.

 

4. Education and Knowledge Transfer

Where services include educational elements (workshops, lectures, written materials), these are intended solely for knowledge development and insight. They do not replace professional medical, veterinary, legal, or regulatory decision-making.

 

5. Liability

Liability of Horse and Talent is limited to the total fee paid for the relevant assignment. Horse and Talent is not liable for:

indirect or consequential damages,

loss of profit or business,

reputational damage,

damages resulting from client decisions or actions of third parties.

 

6. International Context

Horse and Talent acts as an independent external advisor. The client is responsible for:

compliance with all local laws and regulations, obtaining all permits, approvals, and authorisations, application of advice within its organisation or jurisdiction. Visas must be arranged and sponsored by the client. Horse and Talent has no responsibility for visa procedures or outcomes.

 

7. Fees & Payment

Services are provided at an agreed senior advisory day rate. Advisory days are charged at 100% of the agreed day rate. Travel days and jetlag days are charged at 50% of the agreed day rate. For projects long-terms engagements, fees may be agreed on a project basis upon request and will be confirmed in writing prior to commencement.

Fees are exclusive of VAT, local taxes, travel, accommodation, driver, visa, and related expenses. Payment is required in advance (50–100% upfront as agreed). Services commence only after receipt of payment.

 

8. Travel and Related Expenses

For international assignments, all travel, accommodation, and related expenses, including flights, full hotel, driver, and visas, are borne and arranged by the client. Horse and Talent is not obliged to commence services until these costs have been received or confirmed.

 

9. Cancellation by the Client

– Cancellation more than 30 days prior: no fee, incurred costs charged;

– Cancellation 30–14 days prior: 50% of the fee payable;

– Cancellation within 14 days: 100% of the fee payable.

Travel and accommodation costs already incurred are charged in all cases.

 

10. Cancellation or Modification by Horse and Talent

Horse and Talent reserves the right to reschedule or cancel due to force majeure, illness, or unforeseen circumstances. Payments for services not delivered will be refunded. Further liability is excluded.

 

11. Applicable Law

These terms are governed by Dutch law. Disputes are first addressed through mutual consultation.
